No Monetary Value.
The Best Price Guarantee+ benefit has no monetary or resale value, is non-transferable and cannot be redeemed, exchanged or converted into cash unless expressly stated by Travelodge Hotels Asia. The Best Price Guarantee + benefit applies only to the Eligible Booking for which the claim has been approved and may not be sold, assigned or otherwise transferred to any other person.
Restrictions.
Members are responsible for complying with these Terms and Conditions and all applicable laws and regulations relating to their participation in the Program. Travelodge Hotels Asia assumes no responsibility or liability for any Member's failure to comply with such laws, regulations or these Terms and Conditions. The Program shall only apply to the extent permitted by applicable law.
Release.
By participating in the Program, each Member agrees, to the fullest extent permitted by law, to release, discharge and hold harmless Travelodge Hotels Asia, its affiliates, subsidiaries, directors, officers, employees and agents from any claims, losses, damages or liabilities arising out of or in connection with the Member's participation in the Program or the submission of a Best Price Guarantee+ claim, except where such liability cannot be excluded under applicable law.
Updates to Terms and Conditions.
The Program is offered at the sole discretion of Travelodge Hotels Asia. Travelodge Hotels Asia reserves the right to modify, suspend or terminate the Program, or amend these Terms and Conditions, at any time without prior notice. Members are responsible for reviewing these Terms and Conditions periodically. Continued participation in the Program following any amendment constitutes acceptance of the revised Terms and Conditions.
Verification Rights.
Travelodge Hotels Asia reserves the right to request additional information or documentation for the purpose of verifying any claim submitted under the Program. Failure to provide the requested information within the stipulated timeframe may result in the claim being rejected.
Assignment by Travelodge Hotels Asia.
Travelodge Hotels Asia may assign or transfer any of its rights or obligations under the Program at any time to any related or unrelated entity at its sole discretion.
Force Majeure.
Travelodge Hotels Asia shall not be liable for any failure or delay in performing its obligations under these Terms & Conditions where such failure or delay results from circumstances beyond its reasonable control, including system outages, natural disasters, acts of government, or other events of force majeure.
Severability.
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
Statutory Rights. Nothing in these Terms & Conditions excludes, restricts, or modifies any right or remedy that a Member has under mandatory consumer protection or other laws that cannot lawfully be excluded, restricted, or modified in the Member's jurisdiction of residence or in the jurisdiction of the participating hotel, and these Terms & Conditions are to be read subject to any such rights.
Third Parties.
A person who is not a participant in the Program shall have no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any provision of these Terms and Conditions.
Dispute Resolution.
In the event of any dispute relating to the Program or these Terms and Conditions, Members should contact Travelodge Hotels Asia at hello@travelodgehotels.asia. Any unresolved dispute arising out of or in connection with these Terms and Conditions shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the SIAC Arbitration Rules for the time being in force. The seat of arbitration shall be Singapore, the language of the arbitration shall be English, and the Tribunal shall consist of one (1) arbitrator.
Governing Law.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore, subject to the Statutory Rights provision above.
